Terms of Service

By downloading, installing, or using CollecTeKs ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Description of Service

CollecTeKs is a 3D knowledge graph application that allows you to create, organize, and visualize nodes, edges, and collections. The App offers both free and paid (Pro) tiers with different feature sets.

2. Free and Pro Tiers

Free tier: Browse the Library, download collections, view Story Mode, and create/edit one collection with limited nodes.

Pro tier: Unlimited collections, AI-powered analysis, cloud sync, Story Mode creation, publishing to the Library, and media sync. Pro is available as an auto-renewable subscription.

3. Subscriptions and Payment

• Pro subscriptions are billed through your Apple ID via the App Store.
• Available plans: monthly ($9.99/month) and yearly ($79.99/year).
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel subscriptions in your device Settings under Apple ID > Subscriptions.
• No refunds are provided for partial billing periods. Refund requests should be directed to Apple.
• Prices may vary by region and are subject to change. Price changes will be communicated in advance.

4. AI Features

Pro subscribers have access to AI-powered analysis features that process text, photos, and voice input to generate knowledge graph nodes and edges. These features:

• Are subject to a monthly usage budget (currently $1.50 worth of API tokens per month).
• Use Anthropic's Claude AI model for processing.
• May produce inaccurate, incomplete, or unexpected results. AI output should be reviewed by the user.
• Are provided "as is" without guarantees of accuracy or availability.

5. User Content

Ownership: You retain full ownership of all content you create within the App, including nodes, edges, collections, stories, and media files.

Published collections: When you publish a collection to the Library, you grant YazTeKs a non-exclusive, worldwide license to host and distribute that collection to other users. You can unpublish at any time, which removes the collection from the Library.

Responsibility: You are solely responsible for the content you create and publish. Do not publish content that is illegal, infringing, defamatory, or harmful.

6. Acceptable Use

You agree not to:

• Use the App for any illegal purpose.
• Publish collections containing copyrighted material you do not have rights to.
• Attempt to reverse engineer, decompile, or extract source code from the App.
• Abuse the AI features by submitting harmful, illegal, or excessively large content.
• Attempt to circumvent subscription requirements or usage limits.
• Use automated systems to access the App or its API.

7. Intellectual Property

The App, its design, code, branding, and all associated intellectual property are owned by YazTeKs. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes (or commercial purposes with a Pro subscription).

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. YazTeKs does not warrant that the App will be uninterrupted, error-free, or secure. Use the App at your own risk.

YazTeKs is not responsible for data loss. We recommend keeping local backups of important collections.

9. Limitation of Liability

To the maximum extent permitted by law, YazTeKs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or business interruption.

Our total liability for any claim arising from the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

You may stop using the App at any time by deleting it from your device and cancelling any active subscriptions. YazTeKs reserves the right to suspend or terminate access to the App or its services at any time for violation of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms. Material changes will be communicated through the App or our website.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation before pursuing formal legal action.
